In Texas, a person must bring a personal injury action within 2 years of the injury occurring. Although the limit is 2 years, there are some exceptions to the rule that are important to be aware of. Some of those exceptions include:

  • The Age of the Person Injured: If the person who was injured is under the age of 18, then the statute of limitations of 2 years starts when they turn 18. They can bring action before this point, but the clock starts when they turn 18.
  • Sound of Mind: If the person that is injured is of unsound mind, then the statute of limitations will be delayed until that person is of sound mind again. 
  • Discovery of Injury: The statute of limitations will begin when the person becomes aware of their injuries from the accident. This rule is commonly applied in cases where a disease develops years after initial exposure to a hazardous situation.
