What Is Spousal Support In Texas?

Another word that is commonly used in place of spousal support is Alimony. In a divorce proceeding, it is common for a high earning individual to provide spousal support or alimony payments to the other party. This payment structure is generally considered temporary until the divorce proceedings end. There are some scenarios where alimony will last after the divorce proceeding, but that requires that you and your spouse were married for at least 10 years and the receiving spouse needs the support. In the state of Texas, the maximum amount of post-divorce spousal maintenance allowed by the law is $2,500 per month for three years.

Factors That Determine Spousal Support (Alimony)

There are many different factors that the court will consider when determining if a person will receive spousal support from their spouse after a divorce. Some of those factors are:

  • The age, physical and emotional states of you and your spouse.
  • Both partners’ finances.
  • What the length of the marriage was.
  • The collective standard of living you and your partner maintained during the marriage.
  • The amount of time it would take for the recipient to support themselves alone.
